1. General provisions

The following terms and conditions apply to all orders placed by the buyer (hereinafter referred to as “you”) with Clover GmbH (hereinafter referred to as “CLOVER” or “we”) on the CLOVER website, CLOVER mobile website, Mobile applications (collectively referred to as “myclover.de”).

By using myclover.de and / or by placing an order, you agree to be bound by the terms and conditions set forth in this agreement (the “Terms”). Before placing an order, please be sure to carefully read these Terms.

Only individuals 18 years of age and older who are not under guardianship and possessing a sufficient degree of legal capacity to provide services from CLOVER can place orders. CLOVER reserve the right to restrict the delivery of goods to different regions at certain times of the year. This may be due to adverse weather conditions that impede the delivery of goods to these regions.

The inclusion of goods and services in the assortment presented on myclover.de in a certain period of time does not imply or guarantee the availability of these goods and services at any time. We reserve the right to withdraw from sale any product at any time.

We reserve the right to update these Terms from time to time without prior notice. The version of these Terms applicable to your order will be considered the version available on myclover.de at the time of placing your order.

CLOVER is committed to making the shopping process in our online store as comfortable as possible. To do this, we must ensure the uninterrupted provision of our services. You understand the need for the following and agree (i) not to publish, transmit, redistribute, download or advertise any information materials or content that could harm or adversely affect our business, products or services; (ii) not to use any tricks or devices that could prevent or interfere with any other user using the myclover.de website, as well as that could limit the use of this website or adversely affect the security of this website; and (iii) do not use any devices or attempt to use any algorithms, software, tools, agents, scripts or other devices or mechanisms (including but not limited to web spiders, bots, search engines robots, avatars or intelligent software agents to navigate this site, perform a search on this site or copy the content of this site. We reserve the right to immediately prohibit access to this site and close the account of any user who violates this provision or any other provision of these Terms.

2. Prices and delivery costs

Product prices are listed on myclover.de.

Product prices include shipping costs by the standard postal service.

Product prices do not include local taxes and fees that may arise in certain countries when receiving products. Responsibility for paying local taxes and fees lies on the purchaser of the product.

3. Placing an order / concluding a contract

If you have provided us with your email address, then after placing your order, a confirmation message will be sent to this address. If we cannot complete your order for any reason, we will notify you as soon as possible. If we have already received payment for the placed order, we will try to refund the corresponding amount in the same way that was used to make the payment. In all cases, compensation may be made to your bank account. Be sure to include your bank account number and your first and last name so that in case of a return we can pay you compensation for their value. If for any reason it is necessary to settle additional organizational issues, we will notify you of this and ask you to contact CLOVER via email to resolve this situation.

4. Delivery

CLOVER carefully accepts and processes orders, and also tries to deliver the ordered goods depending on the delivery option chosen by the buyer: to the address of residence or to some other address, or to the post office.

CLOVER strives to send orders as soon as possible and in the order they are placed. Delivery time depends on your location. Despite the fact that we strive to deliver orders as quickly as possible, delivery may take longer due to unforeseen circumstances. In the event of a delivery delay of more than 30 days, you can cancel your order.

Prior to placing your order, you will be provided with approximate shipping information. If you provided us with your email address, then after you place an order, a message will be sent to this address with confirmation of the order and approximate information about its delivery.

By default, product delivery is carried out by standard postal services and is included in the price. If you want to receive products in a shorter time, you can order delivery of products by express delivery services. When ordering delivery of products by express delivery services, the cost of delivery of products falls on you.

5. Payment Methods

Payment for goods is carried out by credit / debit card or bank transfer. We are also constantly working on expanding payment methods.

Upon receipt of the ordered goods there is no additional charge.

Please note that we do not accept gift and merchandise cards as a way to pay for orders at myclover.de.

6. Our responsibility

None of these Terms excludes or limits CLOVER’s liability with respect to any aspect in which our exclusion or limitation of our liability would be unlawful.

CLOVER is not liable for consequential losses arising from a major loss or damage, for example, loss of profit or loss of business opportunity, nor is it liable for failure to deliver the ordered goods or for any other obligations set forth in these Terms if this failure or non-compliance is due to force majeure circumstances, including but not limited to fire, flood, storm, rebellion, public unrest, war, nuclear accident and terrorist sky acts.

Our maximum liability to you for any damage or loss arising from the placement of your order on myclover.de is limited to the total value of your order.

7. Colors and sizes

We take all necessary measures to accurately display the characteristics of our products, as well as their colors and the composition of the materials from which these products are made. The colors that you see depend on the settings of your computer system or any other device, and we cannot guarantee the exact transfer of the desired colors by your computer or any other device.

The product dimensions indicated by myclover.de are approximate and are used so that you can get a clearer picture of the model or style, however, their full compliance with the actual dimensions of the product you ordered is not guaranteed. Actual product dimensions may vary depending on the material from which the product is made.

8. Warranty

If a defect is found in the goods you have purchased, CLOVER will fulfill all statutory warranty obligations. Warranty period for goods is 6 months. If you want to complain of obvious defects in material or workmanship of the goods we sent, including damage caused during transportation, please inform us via e-mail info@myclover.de and immediately returning these goods to us using courier service or services of any other transport company of your choice.

9. Outsourcing

CLOVER reserves the right to attract and appoint third-party organizations to consider claims regarding payments related to the delivery of ordered goods.

10. Termination of certain provisions

In the event that any of these Terms is invalidated or excluded by any court or regulatory body, all other Terms shall remain in force.

11. Legal ownership

All intellectual property rights, such as trademarks and copyrights in myclover.de, are owned by CLOVER and its subsidiaries or licensors. Any use of the myclover.de website or its information materials is prohibited, including copying or storage of these information materials in full or in part, for any other purpose than personal, non-commercial use, without the corresponding permission of CLOVER.

12. Applicable Law

The legislation of the Federal Republic of Germany applies exclusively to the extent not regulated by the United Nations Convention on the International Sale of Goods.

The legislation of your country of residence remains in effect to the extent that the choice of German law will lead to the deprivation of legal protection provided by these provisions, which cannot be canceled by agreement in accordance with the legislation of your country of residence.
